Anal Sex Toys and the Law

Did you know that in some states that it was illegal to own an anal sex toy? Believe it or not, some states actually ban the ownership and sale of these kinky little toys. The law states that “any device designed or marketed as useful primarily for stimulation of human genital organs” is illegal to own and/or sell.

This may mean that your douche could be safe because it could be used for medical purposes, but all other sex toys are fair games. Vibrators and dildos are the two anal sex toys that are most looked at by this law.

The reasoning behind the ban in certain states is unknown, but it does make sexual intercourse with toys very difficult. The states that have the ban are:

However, this does not mean that people in these states don’t sell and/or own anal sex toys. There are ways that the government cannot stop your anal sex fun.

Homemade Anal Sex Toys

There is an entire Web page dedicated to homemade anal sex toys, but just to let you know the basics here: these juicy toys are for all and can be made out of ordinary objects that can be found anywhere (the most common example being a cucumber shaped just right for you). And the best part is that it’s not illegal to own a cucumber!

The Educational Loophole

Within this law, there are some sex shops that make consumers of anal sex toys to sign a form stating that their purchase of their dildo, vibrator or whatever they are buying was purchased for the sake of learning. However, this is a loophole and not everybody is actually buying these toys for that purpose, but to avoid the wrath of the government because of this law.

This Law is NOT Federal

If you noticed a pattern that most of these states are in the South, it is easy to simply buy one of these nice little anal sex toys out of state. You could do it over the Internet or do it the old fashioned way: going to a store in a legal state and buying one (or many!). See the below heading for a tip if you consider this step.

Hiding Your Toy in a Safe Place

This is essential in any illegal state (and legal ones too!). Having a good hiding place for your anal sex toy would be especially recommended if you have somebody hide them from! The ideal hiding spot would be somewhere soft, clean and discreet.

The sentence for being caught with one of these sex toys is a year in prison and a fine that depends on what state you are in. The fine can be up to $10,000. With the ways to go around the government legally, this heavy fine won’t have to be paid often.

The controversy behind this is that it goes against the Constitution since freedom of expression and the freedom to have an unwarranted search or seizure have been claimed to be violated by various users and sellers. There is no overturning yet, but there is hope that there will be in due time.
